In October 2020, the employer had announced to<x id=\"gid_3\"><\/x>all employees that wearing a face mask would be mandatory for everyone<x id=\"gid_4\"><\/x>in the workplace from that moment on. The employee refused because<x id=\"gid_5\"><\/x>he saw no good reason for this and found it annoying. He was placed on inactive status without pay until<x id=\"gid_6\"><\/x>he was willing to wear a face mask during work. The employee\nstarted summary proceedings in which he claimed wages.    <\/p>\n\n<p>The subdistrict court in Utrecht ruled in favor of the employer in its <a href=\"https:\/\/uitspraken.rechtspraak.nl\/inziendocument?id=ECLI:NL:RBMNE:2021:51&amp;showbutton=true\">judgment<\/a>: an employer has a right of instruction with which he may issue regulations regarding the performance of the work, especially if they promote \u2018good order\u2019 in the company. The employer had a duty to ensure a safe working environment for his employees and was also allowed to protect his business interests by preventing more employees from becoming ill.
