With a deterioration of the economy, many companies are reorganizing, often with forced redundancies. For this, the employer must apply for a dismissal permit from the UWV, whereby the business economic reason must be demonstrated on the basis of the company’s financial data. The employer must also demonstrate which employees are the first to be considered for dismissal according to the reflection principle. If more than 20 employees are dismissed, it is a collective dismissal for which a Social Plan must be drawn up.
If your employer submits a dismissal application to the UWV, you as an employee will receive a copy of it and you will have two weeks to object in writing. This can be useful, for example, if you have doubts about the business economic reason or if the reflection principle has not been properly applied.
