Many employers have not yet implemented the new vacation legislation. A missed opportunity.

The vacation days legislation has been in effect since January 1, 2012, and shortens the expiration period of vacation days to 6 months after the end of the year in which the vacation days were accrued. This is a significant difference from the expiration period of 5 years that applied until January 1, 2012.

A second important change is that vacation days are also accrued without limit during illness, and must be used by the sick employee. An exception to this is if the employee can reasonably be considered unable to take vacation. In that case, the old statute of limitations of 5 years applies.
