Effective today: Applications for compensation for severance pay in the event of long-term incapacity for work

We would almost forget it in this Corona time, but as of today, the UWV’s counter is open for submitting an Application for compensation for severance pay due to long-term incapacity for work. Just a brief summary:

Conditions for compensation for severance pay

To be eligible for compensation, the following conditions apply:

  • the employee was dismissed after July 1, 2015 due to long-term illness;
  • the employee was legally entitled to severance pay;
  • the employer has paid the severance pay to the employee.

Employers must be able to demonstrate these conditions by submitting a number of documents showing:

  • that there was an employment contract;
  • what the duration of the employment contract was;
  • that the employee left employment while ill;
  • on which date the 104 weeks of illness was reached;
  • that severance pay has been paid (for example, bank statement);
  • how the severance pay was calculated
